Terms of Service

1. Acceptance of the Terms

By accessing and using the IREAL platform (the "Platform"), you accept these Terms of Service ("Terms") in full. If you disagree with any part of these Terms, you must not use the Platform. Continued use of the Platform after updates are published constitutes acceptance of the new Terms.

To create an account and use the Platform you must be at least 18 years old, or the age of majority in your jurisdiction if higher. If you represent a company or organization, you represent that you have the authority to bind that entity to these Terms.

2. Description of the Service

IREAL is a content strategy and storytelling platform that uses generative artificial intelligence to help creators develop personalized content plans. The service includes: social media profile analysis, generation of content plans, editorial calendars and strategies, interaction with and editing of AI-generated plans, and post planning and tracking tools.

IREAL operates as an intermediary platform that uses third-party artificial intelligence services (currently Google Gemini) to generate content. We are not an AI service provider; we are a user of those services, which we make available to you through our interface.

3. Use of Artificial Intelligence — Mandatory Disclosure

3.1 Nature of the AI-powered service

The Platform actively uses generative artificial intelligence systems. When using IREAL you are interacting with AI systems, not with people. The plans, calendars, strategies, and any other content the Platform delivers to you are generated by AI algorithms based on the information you provide.

3.2 AI provider and data flow

We currently use the Google Gemini API to generate content. Your profile information and instructions are sent to Google's servers for this purpose. Google processes this data under its own policies, available at ai.google.dev/terms.

3.3 AI limitations and user responsibility

Due to its probabilistic and generative nature, AI-generated content may:

  • Contain inaccuracies, anachronisms, or outdated information.
  • Not be fully original or distinguishable from other content generated by the same AI.
  • Inadvertently reproduce structures or phrases from its training corpus.
  • Not be eligible for copyright protection in every jurisdiction.
  • Not be suitable for certain sectors, audiences, or markets without human review.

You are solely responsible for reviewing, verifying, and adapting generated content before publishing or using it commercially. IREAL is not liable for consequences arising from the use of content without adequate review.

3.4 No unsupervised automated decisions

The Platform's recommendations and suggestions (strategies, calendars, posting frequencies, etc.) are advisory. IREAL does not make binding decisions about your business or manage your channels autonomously. Any action taken based on the Platform's recommendations requires your active review and decision.

4. Intellectual Property

4.1 Your input content

You own all information, data, text, and instructions you enter into the Platform. By using it, you grant us a limited, non-exclusive, revocable, royalty-free license to process that content solely to provide you the service.

4.2 AI-generated content (Output) — Important Legal Notice

IREAL assigns to you all commercial usage rights to outputs generated from your information, to the extent permitted by applicable law. However, you should be aware of the following legal limitations:

  • Copyright protection: Copyright law in most jurisdictions (including Colombia, the European Union, and the United States) requires human authorship for copyright protection to apply. Content generated entirely by AI may not be eligible for copyright protection, or may fall into the public domain. IREAL cannot guarantee the protectability of generated content.
  • Similarity risk: AI-generated content may show similarities to other content produced by the same models for other users. IREAL does not guarantee the originality or uniqueness of the content.
  • Possible third-party infringement: If a third party claims infringement of their rights over content you published based on the Platform's outputs, that liability rests with you as the publisher, not with IREAL.

Recommendation: For high-value commercial uses (ad campaigns, registered trademarks, editorial content, etc.), perform a substantial human review of generated content before use.

4.3 Ownership of the Platform

IREAL retains all rights to the Platform, including its source code, algorithms, design, brand, and AI system. The license we grant you is personal, non-exclusive, non-transferable, and revocable.

4.4 Aggregated and anonymized data

IREAL reserves the right to use aggregated and anonymized data derived from Platform usage to improve the product and for internal research purposes. This data will never allow personally identifying you or revealing your specific content strategy.

5. Age Restrictions

The Platform is intended exclusively for people over the age of 18. By creating an account, you represent that you are 18 or older. If you are under 18, you must not use the Platform. IREAL does not knowingly collect or process data from minors. If we detect that a user is a minor, we will immediately delete their account and associated data.

6. Acceptable Use of the Service and Generated Content

By using the Platform and its generated content, you agree to:

  • Not generate, use, or publish content that promotes hate, discrimination, or violence.
  • Not use generated content to deceive, defraud, or impersonate third parties.
  • Not use the Platform to generate content that infringes third-party copyrights, trademarks, or other intellectual property rights.
  • Not attempt to extract, copy, or replicate the Platform's AI algorithms or models.
  • Not use scraping, unauthorized automation, or mass access to the Platform's API.
  • Use generated content in accordance with the laws applicable in your jurisdiction.
  • Review generated content before publishing it, especially in professional, advertising, or editorial contexts.

7. Accounts and Subscriptions

To use the Platform you need to create an account via social sign-in (Google). You are responsible for maintaining the security of your account and for all activity performed under it. You must notify us immediately of any unauthorized use of your account at legal@ireal.app.

Subscriptions are personal and non-transferable. You may not share access to your account with third parties.

8. Refund and Cancellation Policy

You can cancel your subscription at any time from your account settings. Upon cancellation:

  • You will retain access until the end of the current billing period.
  • No additional charges will be made after cancellation.
  • Refunds are processed within the first 7 days after the charge. After this period, refunds for the current period are not granted, unless the law applicable in your jurisdiction provides otherwise.
  • Your data and generated content remain accessible for 30 days after your subscription expires.

9. Limitation of Liability

9.1 Service provided "as is"

IREAL provides the service "as is" and "as available". We do not guarantee that the service will be uninterrupted or error-free, nor that AI-generated content will be accurate, complete, original, eligible for copyright protection, or fit for a specific purpose.

9.2 Limits of liability for generated content

IREAL is not liable for:

  • Third-party claims of intellectual property infringement over content you publish based on the Platform's outputs.
  • Direct, indirect, incidental, or consequential damages arising from the use or inability to use generated content.
  • Loss of revenue, reputation, or business arising from the use of content without adequate human review.
  • Inaccuracies or outdated information in generated content.

In any case, IREAL's maximum liability to you will not exceed the amount you paid for the service in the 3 months preceding the event giving rise to the claim.

9.3 Indemnification

You agree to indemnify and hold harmless IREAL, its officers, employees, and partners against any claim, damage, loss, or expense (including legal fees) arising from: (i) your use of the Platform in violation of these Terms; (ii) publishing generated content without adequate review; (iii) any infringement of third-party rights arising from content you publish.

10. International Data Transfers

By using the Platform, you accept that your data may be transferred to and processed on servers located outside Colombia, including in the United States and the European Union, where our infrastructure and AI service providers operate (Supabase, Google Cloud, Apify). We implement contractual safeguards to ensure these transfers meet applicable data protection standards.

11. Rights of Users in Specific Jurisdictions

11.1 Users in Colombia

The processing of your personal data is governed by Law 1581 of 2012 and its implementing decrees. You have the right to know, update, rectify, and delete your personal data. To exercise these rights, contact us at privacidad@ireal.app.

11.2 Users in the European Union and EEA

If you are a resident of the European Economic Area (EEA), you have additional rights under the General Data Protection Regulation (GDPR), including the right of access, rectification, erasure, portability, restriction of processing, and objection. Contact us at privacidad@ireal.app to exercise any of these rights. We respond within a maximum of 30 days.

11.3 Users in California (USA)

If you are a California resident, you have rights under the CCPA/CPRA, including the right to know what personal data we collect, to request its deletion, and not to be discriminated against for exercising these rights. We do not sell your personal data.

12. Changes to the Terms

We reserve the right to modify these Terms of Service. We will notify you of significant changes through the Platform or by email at least 15 days in advance. Continued use of the Platform after the changes take effect constitutes acceptance of the new Terms. If you do not accept the changes, you may cancel your account before they take effect.

13. Governing Law and Dispute Resolution

These Terms are primarily governed by the laws of the Republic of Colombia. Any dispute will preferably be resolved through mediation. If no agreement is reached through mediation, disputes will be resolved by the competent courts of Colombia, unless the law of your country of residence establishes a different mandatory venue.

14. General Provisions

If any provision of these Terms is declared invalid or unenforceable, the remaining provisions will remain in full force. Failure to exercise any right under these Terms does not constitute a waiver of that right. These Terms constitute the entire agreement between you and IREAL regarding use of the Platform.
